Violation of the rules for the use of personal data is sanctioned!

The public institution “Public Services Agency” has been notified by the Ministry of Internal Affairs of the Republic of Moldova on the phenomenon recently encountered on social networking sites, namely the posting of ads about finding identity documents, driving licenses and other documents containing personal data, in order to identify their owners.

Often, these posts are accompanied by pictures of those documents. Although the purpose seems to be noble, it does not always take into account the possible risks to which both the legal owner of the lost act and the user posting the information are subjected.

According to paragraphs (3) and (4) of Article 741 of the Contravention Code of the Republic of Moldova, the violation of the personal data subjects right to be informed, to access personal data, to intervene on personal data, to oppose and not to be subject to an individual decision, as well as the violation of rules on the use of personal data, are contraventions and shall be sanctioned with:

  • a fine in the amount of 60 to 90 conventional units for an individual;
  • a fine in the amount of 90 to 180 conventional units for an executive officer;
  • a fine in the amount of 120 to 300 conventional units applied to a legal entity with or without deprivation, in all cases, of the right to carry out certain activity for a period of 3 months to one year.

Personal data published on social sites make vulnerable the safety of people, who may become victims of abuses, such as identity theft, financial loss or other offenses committed through the illicit use of their personal data.

Thus, the holders of identity documents are required to inform without delay  the competent bodies about the loss or finding of the identity document in accordance with paragraph (c) of  Article 8 of Law No 273-XIII of November 9,1994 on identity documents of the national passport system.

It should be noted that the identity document found by a third person shall be delivered to the issuing authority. In case when the third person stays abroad, the identity document is delivered to the diplomatic missions or consular offices of the Republic of Moldova.

In order to ensure the protection of personal data of the subject of personal data, as well as to reduce the risks implied by their disclosure, we draw your attention to the compliance with the provisions of the current legislation.
