The religious cults and their component parts are registered by the Public Services Agency respecting primarily the relations related to freedom of conscience, thought and religion, which are guaranteed by the Universal Declaration of Human Rights, the Constitution of the Republic of Moldova, the Law no.125-XVI/2007 on freedom of conscience, thought and religion and international human rights treaties to which the Republic of Moldova is a party, as well as the legal status of religious denominations and their component parts.
The Church „Dormition of the Most Holy Mother of God” in Dereneu village, Calarasi district, was registered on October 14, 1996 as a component part of the Orthodox Church of Moldova (Metropolitanate of Moldova).
Subsequently, on August 23, 2017, by the decision of the Ministry of Justice of the Republic of Moldova, the status of the Religious Community the Orthodox Parish „Dormition of the Most Holy Mother of God” within the Bessarabian Metropolitanate , in Dereneu village, Calarasi district, was registered, in a new edition, with the change of the name from the “ Church „Dormition of the Most Holy Mother of God” in Dereneu village, Calarasi district – a component part of the Moldovan Orthodox Church (Metropolitanate of Moldova)” into the “Religious Community the Orthodox Parish „Dormition of the Most Holy Mother of God” within the Bessarabian Metropolitanate, in Dereneu village, Calarasi district, based on the Minutes no.1 of August 6, 2017.
Later, on August 17, 2020, the Public Services Agency received the request of the members of the relevant Religious Community with the set of documents related to the registration and amendments to the constituent documents and data entered into the State Register of Legal Entities.
Following the examination of the submitted documents, in accordance with the legal requirements, by the decision of August 21, 2020, the Public Services Agency registered in the State Register of Legal Entities the data on the amendments requested by the Religious Community the Church „Dormition of the Most Holy Mother of God” within the Moldovan Orthodox Church, Calarasi district, Dereneu village.
In this context, the procedure of examining the documents submitted to the Public Services Agency was observed, as well as the decision issued by the registration body on August 21, 2020, was adopted in strict accordance with the provisions of the legislation in force.
It should be noted that the identification, acceptance, exclusion of members, as well as their registration is related to the internal activity of the legal person (of the Religious Community), according to the statutory provisions and exceeds the competencies of the Public Services Agency.
Currently, the Public Services Agency examines two requests from the members of the respective religious entity regarding the amendments to the constituent documents and data from the State Register of Legal Entities. Thus, the Public Services Agency examines, in the light of the provisions of the legislation in force, the submitted documents and under legal terms will issue the corresponding decisions in this respect.
In the event of disagreement with the decision issued by the registration body, its veracity is to be established by the court. Or, in accordance with the provisions of Article 14 (3) of Law no. 220-XVI/2007 on state registration of legal entities and individual entrepreneurs, the decision on registration may be appealed to the court and may be annulled only by the court.
