The Certification Commission attached to the Public Services Agency and authorized to assign the status of public utility to non-commercial organizations has started its activity. Its first working meeting is to be held on April, 22.
Non-commercial organizations may apply for the status of public utility if they cumulatively meet the conditions mentioned in article 21, paragraph (1) of Law no. 86/2020.
The dossiers for assigning the status of public utility, on paper, can be submitted to the Chisinau Multifunctional Center no. 2 (47 Pushkin Street), from Monday to Friday, 8:00-17:00, without pre-registration. The documents must meet the conditions provided for in article 25, paragraph (1) of Law no. 86/2020.
The Certification Commission shall examine the application for assigning the status of public utility within one month from the date of submission of the complete dossier. If the documents submitted to the Certification Commission are incomplete, the secretariat of the Certification Commission shall give the applicant no more than 10 days to correct the deficiencies.
Meetings of the Certification Commission shall be held at least once a month. The date and time of the meetings are established by the Chairman of the Certification Commission after a consultation with the members and are published on the official website of the Public Services Agency.
The non-commercial organization, to which the status of public utility has been assigned, benefits from the following financial and material support of the central and local public authorities:
- tax benefits provided in accordance with the law;
- the right to use public property granted free of charge or on preferential terms;
- non-reimbursable funding;
- conclusion of service and works contracts;
- special-purpose funding, including social contracting. Social contracting is carried out in accordance with the legislation on public procurement. In the case of social contracting no performance security is required.
The Certification Commission attached to the Public Services Agency consists of 9 members, 3 of which are appointed by the Parliament, 3 - by the President of the Republic of Moldova and 3 - by the Government.
