The Public Services Agency has established a new procedure for registering condominiums and Associations of condominium owners

On January 29, 2023, all the rules provided for in Law no. 187/2022 on Condominium, except for some articles that regulate the incorporation of the condominium in the buildings placed in service by 29.07.2023 and some special regulations regarding the lands on which the condominium buildings are located, entered into force. The latter enter into force on July 29, 2023. Upon entry into force of the new law, a number of normative acts, the Law on Condominium in Housing Stock no. 913/2000 inclussively, are amended and repealed.

In order to implement the provisions of Law on Condominium the Public Services Agency established a new procedure for the examination of applications for the registration of the condominium in the Register of Immovable Property and simultaneous examination of applications for the registration of Associations of condominium owners in the State Register of Legal Entiries.

Thus, if the instrument setting up the condominium provides that the owners are organized in the form of an association, the application for registration of the condominium will be submitted to the registrar in the multifunctional center that serves the locality situated in the service area of the territorial cadastral body. The application for the registration of the association of condominium owners will also be submitted to the same multifunctional center.

The pre-registration system of the Public Services Agency will be adjusted to efficiently organize the simultaneous submission of applications for registering condominium and owner association. The applicants will be assisted by the Agency's employees to efficiently plan their visit to the chosen multifunctional center.

Starting 29.01.2023, associations of co-owners in the condominium founded before the entry into force of Law no. 187/2022 shall be considered associations of condominium owners, the fact that constitutes grounds for registration, ex officio, of changes in both the legal form of organization and full and abbreviated name of the association in the State Register of Legal Entities. The changes are registered without publishing the corresponding notice in the „Monitorul Oficial” of the Republic of Moldova and without paying a registration fee.

Within 18 months from the date of entry into force of Law no. 187/2022, associations of owners of privatized housing/apartments, housing cooperatives and housing construction cooperatives shall be reorganized by transformation into associations of condominium owners.

The decision regarding the transformation of associations of owners of privatized houses/apartments, housing cooperatives and housing construction cooperatives is taken by its administrator, without the decision of the general meeting of its members (participants).

The decision on the transformation is the basis for the registration by the state registration body, ex officio, of the transformation, of the change of the legal form of organization and of the full and abbreviated name of the association in the State Register of Legal Entities. The transformation is registered without publishing in the „Monitorul Oficial” of the Republic of Moldova and without paying the registration fee, provided that the application for registering the transformation is submitted within 18 months from the date of entry into force of Law no. 187/2022.
