1. General provisions
1.1. These Terms and Conditions establish the rules for the use of the official website of the Public Institution “Public Services Agency” (hereinafter – the Agency), available at www.asp.gov.md (hereinafter – the Website).
1.2. The Website is intended to ensure public access to information of public interest regarding the activities of the Agency, descriptions of the public services provided, as well as other electronic resources and functionalities made available to users.
1.3. These Terms and Conditions are drawn up in accordance with the provisions of Law No. 234/2021 on public services, the Administrative Code of the Republic of Moldova No. 116/2018, Law No. 91/2014 on electronic signatures and electronic documents, Law No. 142/2018 on data exchange and interoperability, Law No. 195/2024 on the protection of personal data, Government Decision No. 728/2023 on the official websites of public authorities and institutions and the minimum requirements for their social media profiles.
1.4. Accessing and using the Website implies acceptance of these Terms and Conditions.
2. Use of the Website
2.1. Users may access the information and functionalities available on the Website in accordance with their intended purpose and the provisions of the applicable legislation.
2.2. The Website may provide access to electronic services, forms, information systems, government platforms or other digital resources administered by the Agency or by other public authorities. Their use is subject to the specific conditions applicable to each service or information system.
2.3. The information published on the Website is for informational purposes, except where otherwise expressly provided by law or by the published content.
2.4. The user undertakes to use the Website in good faith and in compliance with the legislation of the Republic of Moldova.
2.5. It is prohibited to:
- use the Website for purposes contrary to the law;
- attempt to gain unauthorised access to the Agency’s information resources;
- carry out actions that may affect the security, integrity, availability or operation of the Website;
- transmit, through the Website’s functionalities, false information or software or computer code that may affect the operation of information systems.
3. Availability of the Website
3.1. The Agency makes the necessary efforts to ensure the proper operation and availability of the Website.
3.2. Access to the Website or certain functionalities thereof may be temporarily suspended or limited in the event of maintenance work, updates to information systems, remediation of technical incidents or other objective situations affecting its operation.
3.3. The Agency does not guarantee uninterrupted operation of the Website and is not liable for temporary unavailability caused by factors beyond its control, including failures of electronic communications networks, information infrastructure or external services used for the operation of the Website.
4. Intellectual property
4.1. The content of the Website, including texts, graphic elements, logos, images, structure, design and other published materials, is protected in accordance with copyright and related rights legislation.
4.2. Reproduction, distribution, modification or use of the Website content is permitted only under the conditions provided for by the legislation of the Republic of Moldova and, where applicable, with indication of the source.
4.3. The Agency’s trademarks, names and visual identity elements may not be used in a manner that may create confusion regarding the origin of the information or the existence of an official relationship with the Agency.
5. Protection of personal data
5.1. The processing of personal data through the Website is carried out in accordance with the provisions of Law No. 195/2024 on the protection of personal data.
5.2. Information on the manner in which personal data are processed and cookies are used is available in the Privacy Policy.
6. Amendment of the Terms and Conditions
6.1. The Agency reserves the right to amend or update these Terms and Conditions whenever necessary, including as a result of changes in legislation, development of the Website or updates to its functionalities.
6.2. The updated version of the Terms and Conditions takes effect from the date of publication on the Website, unless otherwise provided.
